1. Acceptance of Terms

By accessing or using SpotMe ("the Service"), operated by SpotMe Ltd ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

SpotMe provides photo marketing tools for events, including fiducial marker-based photo matching, photo upload and distribution, and participant management. The Service is intended for lawful event photography purposes only.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.

4. Acceptable Use

You agree NOT to use the Service to:

  • Upload, store, or distribute any content that is illegal, obscene, pornographic, sexually explicit, or depicts nudity
  • Upload content depicting minors in any inappropriate context
  • Send spam, unsolicited communications, or use the Service for bulk messaging
  • Use the Service as a general-purpose file hosting, image hosting, or content distribution platform
  • Upload content that infringes on intellectual property rights of others
  • Distribute malware, viruses, or any harmful code
  • Engage in any activity that could damage, disable, or impair the Service
  • Attempt to gain unauthorised access to any part of the Service
  • Use the Service for surveillance, stalking, or harassment
  • Resell or redistribute the Service without our written consent

5. Content Policy

All photos uploaded must be legitimate event photography. We reserve the right to:

  • Remove any content that violates these terms without notice
  • Suspend or terminate accounts that violate our content policy
  • Report illegal content to relevant authorities
  • Implement automated content moderation systems

Repeated violations will result in permanent account termination without refund.

6. Payment and Refunds

Events are billed per event based on participant count. Payment is required before event activation. Refunds may be issued at our discretion for events that have not yet received photo uploads. No refunds will be issued for events with uploaded content.

7. Data and Privacy

Our use of your data is governed by our Privacy Policy. By using the Service, you consent to our data practices as described therein.

8. Intellectual Property

You retain ownership of all photos you upload. By uploading content, you grant us a limited licence to store, process, resize, and serve the content for the purpose of providing the Service. This licence terminates when you delete the content or your account.

9. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms. You may terminate your account at any time. Upon termination, your data will be deleted within 30 days.

11. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to Terms

We may update these terms from time to time. We will notify registered users of material changes via email. Continued use of the Service after changes constitutes acceptance.
